Introduction

These Terms of Service ("Terms") are an agreement between you and devmesh ("we," "our," or "us"), a Canadian software studio. They apply when you download, install or use one of our applications. By using an app, you agree to these Terms. If you do not agree, please do not use the app.

Which Apps These Terms Apply To

These Terms cover every devmesh application that does not have terms of its own, including:

• Math Minute
• SeerrTV (and its predecessor, OverseerrTV)
• Pickleball Mixer

Pickleball Tourney is a service at pickleballtourney.ca with its own terms, and these Terms do not apply to it. How we handle information in our apps is described in our Privacy Policy, which forms part of these Terms.

Your Licence to Use Our Apps

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use our apps on devices you own or control, for your own personal or classroom use, in line with these Terms and the rules of the app store you got the app from (the Apple App Store or Google Play). The apps and their content remain the property of devmesh.

SeerrTV is open source. Its source code is also available under its open-source licence, and nothing in these Terms limits the rights that licence gives you over the code.

Acceptable Use

When using our apps, you agree not to:

• Use them for any unlawful purpose or in breach of any applicable law
• Try to get around in-app purchases, advertising or other app features, except as the app itself allows
• Interfere with or disrupt the apps or any service they connect to
• Resell or redistribute the apps, except as an open-source licence permits for that app

In-App Purchases

Math Minute and Pickleball Mixer each offer a single one-time in-app purchase; neither is a subscription. In Math Minute it unlocks further operations, number ranges and quiz lengths. In Pickleball Mixer it permanently removes advertising.

Purchases are processed by the Apple App Store or Google Play and are subject to that store's terms. Refunds are handled by the store you bought from, under its refund policy. A purchase is tied to the store account you made it with and can be restored on your other devices signed in to that account.

Third-Party Services and Content

Some apps work with services we do not operate. SeerrTV connects only to the Overseerr, Jellyseerr or Seerr server you set it up to use, and plays media through apps such as Plex, Jellyfin or Emby. Pickleball Mixer shows advertising served by Google AdMob unless you have bought the option to remove it. Those services and their content are governed by their own terms, and we are not responsible for them. You are responsible for having the right to use any server or media you connect our apps to.

Your Data

Our apps store their data, such as quiz history, student profiles, player groups and settings, on your device. Uninstalling an app or clearing its data may permanently delete it, and we cannot recover it for you.

Updates and Availability

We may update our apps to fix problems, add features or meet store requirements, and some updates may be needed to keep using an app. We aim to keep our apps available and working, but we may change or stop offering an app in the future.

Disclaimer

We build our apps with care, but to the extent permitted by law they are provided "as is" and "as available," without warranties of any kind beyond those that the law requires. Math Minute is a practice tool and does not replace instruction from a teacher. Pickleball Mixer's scores, standings and schedules are only as accurate as the information entered into it.

Limitation of Liability

To the extent permitted by law, devmesh is not liable for any indirect, incidental or consequential loss arising from your use of our apps, and our total liability to you for any claim relating to an app is limited to the amount you paid for that app or its in-app purchase.

Your Consumer Rights

Nothing in these Terms limits or excludes any rights you have under the consumer protection laws of the country where you live, including in the European Economic Area and the United Kingdom, where those rights cannot be limited or excluded by agreement. Where these Terms conflict with those laws, those laws apply.

Ending These Terms

You can stop using an app at any time by uninstalling it. We may end your licence to use an app if you seriously breach these Terms.

Governing Law

These Terms are governed by the laws of Canada. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page, and the date at the top will be revised. Continuing to use an app after a change means you accept the updated Terms.
